Woman says suspect in theft of Tim Allen's car stalked, sexually ...

DENVER ? A Denver woman says the man accused of stealing Comedian Tim Allen?s car stalked and sexually abused her.

The woman told FOX31 Denver in an exclusive interview that she wants the man off the streets for good. She?s asking the TV and movie star for help doing that.

Faustino Ibarra is in jail in Denver. He?s suspected of taking Tim Allen?s prized 1996 Chevrolet Impala and driving it from Los Angeles to Denver.

People who know Ibarra say his obsession with Allen goes back a long way.

Reporter Justin Joseph spoke with Ibarra inside Denver?s jail. The suspect will likely face charges related to stalking the actor and stealing his car on Thanksgiving.

?He left the keys so that I could get the car and drive it Denver,? Ibarra says.

The special car turned up Friday outside Ibarra?s home in Denver.

The woman, who doesn?t want to be identified, came forward and says Ibarra stalked her. ?He sexually abused me for a very long time.?

?He?s insane. I don`t know how to explain it except that he?s very crazy and needs to be removed from society where he?s a threat,? she says.

The stalking stopped years ago after she says Ibarra moved to Los Angeles where he lived in his car near the Hollywood sign.

Though he remembers differently, witnesses say he set up home just outside Allen?s gates.

?He took me in as his own pretty much? especially at the start of his career,? Ibarra claims.

We asked Ibarra?s family about a call from Allen?s security team, demanding they bring him home. ?He?s not dangerous, he?s just crazy,? one of them told us.

But the woman FOX31 Denver spoke to says Ibarra is both dangerous and crazy. She?s pleading with Tim Allen to press charges against the suspect.

?I want to beg and plead with Mr. Allen to not give him a chance to come out again and harm me and stalk me and give him that chance for me to fear for my life.?

Tim Allen?s publicist says she can?t comment on the situation because it?s an ongoing investigation.

The Denver District Attorney?s office says Ibarra will be extradited to California to face charges.

On the same day that former Saints assistant Mike Cerullo testified in the bounty appeal hearing convened by former Commissioner Paul Tagliabue, Judge Helen Berrigan issued a reminder that she has ultimate jurisdiction over the process.

And she hinted that she?s leaning against the league?s position.

Larry Holder of the New Orleans Times-Picayune has obtained an order entered by Judge Berrigan on Thursday.? Here?s the full text of it:? ?In light of the CBA Appeal Panel?s Decision of September 7, 2012, that ?pay for performance? discipline was within the exclusive jurisdiction of the Systems Arbitrator, anticipating that the forthcoming decision by Mr. Tagliabue may be subject to an expedited review as to its fundamental fairness, and assuming as undisputed the testimony by the New Orleans Saints players and coaches that only ?legal hits? were used to intimidate and/or injure opposing players, the parties shall brief the following: 1. Does Articles 43 and 46 of the CBA exclude discipline by the Commissioner for ?legal? contact? 2. Does the CBA give the players and coaches adequate notice as to what conduct could be sanctioned as ?conduct detrimental?? In other words, is that portion of the CBA ambiguous, hence unenforceable? Counsel should discuss the significance, if any, of the separate provision for sanctions upon players for ?unnecessary roughness or unsportsmanlike conduct on the playing field with respect to an opposing player? in Article 46, Section 1(b) from ?[a]ll disputes involving a fine or suspension imposed upon a player for conduct on the playing field? and ?conduct detrimental? in Section 1(a). Reference to relevant NFL rules defining ?legal? and ?illegal? contact is welcomed, as well as a discussion of examples of ?conduct detrimental? provided in the CBA and related documents.?

In English, Judge Berrigan wants the parties to submit written documents that address specific angles and issues that may be relevant to her decision about the imposition of punishment on players for a pay-for-performance system based on clean, legal hits that kept opponents from continuing in a given game.? The way the questions are written suggests that she has identified specific problems that the NFL may have under the Collective Bargaining Agreement.

For example, Judge Berrigan wants the parties to address whether discipline for ?legal? on-field contact is prevented because she apparently thinks it may be.? Likewise, she wants to know whether the CBA gives players and coaches ?adequate notice? regarding the conduct that could be regarded as ?conduct detrimental? because she thinks it may not.

Judge Berrigan also seems to think that the punishment for clean, legal hits falls under the portion of the CBA that gives Ted Cottrell or Art Shell exclusive jurisdiction over the disciplinary process ? an argument that the NFL surely will argue the players have waived by not raising it under the CBA.

Regardless of the arguments raised by the parties, the order seems to be good news for the players, and bad news for the NFL.? The fact that it was issued at a time when key witnesses in the case against the players are testifying could rattle the league?s lawyers and create a sense that, no matter what happens before Tagliabue, the suspensions will ultimately be thrown out.

Phoenix was abused and murdered at age five by her mother, Samantha Kematch and Kematch's boyfriend, Karl McKay, at their Fisher River First Nation home in June 2005, a few months after she was returned to Kematch's care and her CFS file closed. When Phoenix Sinclair was born, she was taken immediately into the care of Winnipeg Child and Family Services largely based on risk concerns presented by her mother's alarming background, ambivalence toward parenting and her family's circumstances.

After a few months, CFS would conditionally give Phoenix back to Samantha Kematch and father Steve Sinclair after the couple showed willingness to work with the agency as defined by a case plan.

That plan included key provisions: They would accept occasional help from an in-home support worker for a few months time and have regular contact with CFS social workers.

But between Sept. 5, 2000 and Feb. 7, 2001 ? a period of five months ? no CFS worker stepped foot in the family's North End home.

The in-home support worker stopped seeing the family sometime in early December after her contract lapsed without CFS making a conscious decision to let that happen.

An inquiry into Phoenix's 2005 death and her involvement in the child-welfare system has heard that when social worker Delores Chief-Abigosis finally got around to seeing the girl's family, elements of their case plan remained unfulfilled ? including, notably, a follow-up psychological assessment for Kematch.

Chief-Abigosis noted she would follow up with the family.

But instead, there was another months-long lull in contact.

By late April, Kematch and Sinclair had another child and named it Echo.

This time around there was no apprehension by CFS and the couple was allowed to leave the hospital with their new baby unimpeded.

Chief-Abigosis would find out about Kematch's pregnancy ? the third in her life she had not disclosed to the agency ? through a phone call from her supervisor at the time, Angela Balan.

Balan testified Wednesday that despite being aware of the family and Kematch's history through prior dealings with the file and Chief-Abigosis, she couldn't say they were in a "high-risk" situation.

Instead, she said, she'd consider the Kematch-Sinclairs a "family of concern."

"It's difficult to assess risk just based on the information that you've provided me," she told commission lawyer Derek Olson.

"Typically with young children, we would have a great deal more concern," Balan said.

Case supervision notes relating to the entirety of Phoenix's CFS involvement "cannot be located," the inquiry has been told.

Balan said she directed Chief-Abigosis to make contact with the family after learning of Echo's birth ? but not right away. Instead, she and Chief-Abigosis elected they would wait to let the family settle in so not to catch them in "transition" from hospital to home. She said she expected it to be done within two to three days.

It wasn't disclosed exactly when Kematch was discharged from the hospital, but Chief-Abigosis visited the home on May 9, 2001, more than a week after Echo's birth. She found no one home and left.

By June 29, however, Balan received an alarming email which she forwarded on to Chief-Abigosis.

It outlined a tip CFS got from an anonymous caller. He said weeks earlier, on June 15, Kematch and Sinclair had a dust-up, Kematch had been kicked out and there were concerns about Sinclair's drinking and the welfare of the kids.

While a case worker was dispatched to check in on the family right away, Chief-Abigosis didn't make it out to see them for another week, until July 6. By then Sinclair and Echo were largely on their own with Phoenix spending large chunks of time with friends of Sinclair's. Chief-Abigosis didn't investigate where Phoenix was living or with whom.

Balan testified she was unaware that Chief-Abigosis was attending school full-time while working also full-time for Winnipeg CFS and commuting to and from Brokenhead for work.

Her testimony continues.

White House, Congress talk as 'fiscal cliff' nears

WASHINGTON (AP) ? An end of the year deadline rapidly approaching, President Barack Obama and Republican House Speaker John Boehner conferred briefly Wednesday night on how to avert the economy-rattling "fiscal cliff," their first one-on-one discussion in five days.

Obama and Boehner's 15-minute phone call came amid increasing anxiety that the White House and top Republicans are wasting time needed to negotiate a way out of a series of tax increases and spending cuts due to begin in January. Treasury Secretary Timothy Geithner and senior White House aide Rob Nabors were also to visit separately Thursday with the four leaders of the House and Senate.

There has been little evident progress in negotiations between the two sides. Republicans complain that the White House is slow-walking the talks and has yet to provide specifics on how Obama would curb the rapid growth of benefit programs like Medicare and Medicaid.

"We have not seen any good-faith effort on the part of this administration to talk about the real problem that we're trying to fix," said House Majority Leader Eric Cantor, R-Va.

Obama is mounting a public campaign to build support and leverage in the negotiations, appearing at the White House with middle-class taxpayers and launching a campaign on Twitter to bolster his position.

"Right now, as we speak, Congress can pass a law that would prevent a tax hike on the first $250,000 of everybody's income," Obama said. "And that means that 98 percent of Americans and 97 percent of small businesses wouldn't see their income taxes go up by a single dime."

Obama is insisting that tax rates go up on family income exceeding $250,000; Boehner is adamant that any new tax revenues come from overhauling the tax code, clearing out tax breaks and lowering rates for all.

Republicans are also demanding significant cuts to so-called entitlement programs like Medicare, such as an increase in the eligibility age for the program from 65 to perhaps 67.

"It's time for the president and Democrats to get serious about the spending problem that our country has," Boehner said at a news conference Wednesday in the Capitol. Boehner, like Obama, expressed optimism that a deal could be reached.

At issue are steep, across-the-board cuts to the Pentagon and domestic programs set to strike the economy in January as well as the expiration of Bush-era tax cuts on income, investments, married couples and families with children. That combination of tax increases and spending cuts would wring more than half a trillion dollars from the economy in the first nine months of next year, according to the Congressional Budget Office.

No one anticipates a stalemate lasting that long, but many experts worry that even allowing the spending cuts and tax increases for a relatively brief period could rattle financial markets.

From their public statements, Obama and Boehner appear at an impasse over raising the two top tax rates from 33 percent and 35 percent to 36 percent and 39.6 percent. Democrats seem confident that Boehner ultimately will have to crumble, but Obama has a lot at stake as well, including a clear agenda for priorities like an overhaul of the nation's immigration laws.

Obama is also meeting privately Thursday with his defeated Republican rival Mitt Romney. The president has cast his victory over Romney as a sign that Americans back his tax proposals, which were a centerpiece of his re-election campaign.

While in Washington, Romney will also meet with his former running mate, Rep. Paul Ryan. The Wisconsin congressman is chairman of the House Budget Committee and deeply involved in the fiscal cliff discussions.

Obesity Prediction Calculator Reinforces Parents' Role in Child's ...

I have what I like to call an irrational fear of my daughter being overweight. It?s irrational because our lifestyle in no way engenders a possibility that she will be one of the millions of overweight or obese children in our country. She?s also 2.5 years old and never strays far from the third percentile for weight.

Blame it on my profession and the amount of information I?m inundated with daily, but I?ve got a tall soapbox when it comes to children?s health, especially my daughter?s. So when I see news of an obesity prediction calculator, believe I clicked through and ran those numbers.

The predicted probability that my daughter will be obese is 24.14 percent. That?s not an unreasonable number. I certainly wish it were lower. At the end of the day, I put the bulk of that responsibility on my very shoulders. In my opinion, every parent should be the sole barer of that responsibility.

The Obesity Prediction Calculator was developed by researchers at Imperial College London who believe that a particular equation can accurately predict your child?s propensity for being obese. The calculator asks for the mother?s BMI, father?s BMI, mother?s professional category (i.e. unskilled, skilled, professional), mother?s gestational smoking history, and the child?s birth weight. Six factors that, these researchers say, influence a child?s weight.

Researchers told FoxNews they could ?accurately predict childhood obesity up to 85 percent of the time.? They say these environmental factors were more telling than genetic; in fact, they said genetic variables were not very reliable in the prediction.

Brooke Randolph, LMHC, and DietsInReview.com?s resident mental health expert, backs up their research by saying, ?It really seems that genetic factors account for a small percentage of cases of childhood obesity. Activity and diet play a much larger role in childhood obesity. That may not be easy for some parents to hear, but maybe they can find some hope in knowing that they can make a difference for their kids.?

For the one-third of American children who are already categorized as obese or overweight, there?s not much to learn from this calculator that parents probably don?t already know. Obese children tend to grow in to obese adults, making it all the more important to instill healthy eating habits and an active lifestyle as early as possible. But for the other 66 percent of children in the U.S., this calculator could reinforce to parents what health experts have been more or less preaching for years ? do something!

Childhood obesity is a legitimate health crisis in our country, and one that?s spreading through the world via a phenomenon known as ?globesity.? If a parent has a child who is seemingly healthy, but gets an obesity prediction of say 75 percent or maybe even higher, that should serve as a flag to, depending on age, start making changes or focus on laying the foundation for healthy habits from the start. Developing a child?s eating habits is far easier than trying to change those of an elementary- or middle-school aged child.

?It is difficult for adults to change their own eating habits, but even more difficult to change a child?s eating habits if he or she is not motivated to change,? commented Randolph. ?Food habits may be more difficult to change because it is involved so heavily in our lives and often paired with nurturing ?and memories of feeling loved and comforted.?

What 24 percent says to me is that, for as healthful as we live, it?s still possible for my daughter to gain an unhealthy amount of weight. That number reinforces everything I do with her ? she eats what we eat, she?s never been to a McDonald?s, she?s never had soda and the very small amount of juice she drinks is mostly watered down. She can name nearly every fruit and vegetable in the produce section because she eats all of them regularly. And the girl plays, hard. We don?t take a stroller or wagon on our evening walks and we go out of our way to make sure she?s moving, running and jumping throughout the day to the point that I actually allow her to jump on the bed. The most important thing we do is model these behaviors ourselves and that will have the most lasting affect.

?Modeling may be one of the strongest tools in a parent?s arsenal,? said Randolph. ?Do what I say not what I do really never works on kids. If there are cookies hidden that you only get out after bedtime, they know about them and know you are eating them. Every child looks forward to being an adult and doing all the things grownups do that they cannot. When you have things that are ok for adults but off limits for kids, it increases their desire to try them ? clearly you think it is a good thing.?

OSU enrollment growth paces Oregon University System record

CORVALLIS, Ore. ? Oregon State University?s fall term enrollment ? fueled by major increases in minority students from the United States and international students ? grew by 4 percent on the main Corvallis campus (from 22,335 to 23,218 students) from fall term of 2011.

A robust online enrollment pushed the university?s overall growth to a record total of 26,393 students, a 5.7 percent increase over OSU?s overall enrollment last year.

OSU continued to experience modest growth in the number of students from Oregon, reaffirming President Ed Ray?s commitment to the university?s Land Grant mission of access.

Some of the growth in OSU?s enrollment can be attributed to its ECampus program, which enrolled a record 3,175 students from around the state and beyond who only took courses from the university online. ECampus has been ranked among the top 10 online programs in the country.

?Our enrollment growth is a reflection of interest in the university?s academic programs, our success in recruiting high-achieving students, and our efforts to increase minority and international enrollments,? said Sabah Randhawa, OSU?s provost and executive vice president. ?We are managing our growth in alignment with our strategic goals and with our commitments to the Oregon University System to contribute to the educational goals outlined in the 40/40/20 aspiration for the state.?

OSU?s enrollment total does not include that of the state?s first branch campus, OSU-Cascades in Bend, which has an additional 801 students ? an increase of 4.8 percent over last year. The growth rates of OSU and OSU-Cascades were the highest in the Oregon University System, which posted an overall record.

Some of the highlights of the university?s enrollment:

  • The number of U.S. minorities increased 10.7 percent over 2011 to a total of 5,224 students. U.S. minority students now comprise 19.8 percent of the university?s enrollment.
  • OSU?s international student enrollment increased 27.5 percent over last year, a reflection in part of the successful collaboration with INTO University Partnerships. OSU?s international student enrollment this term is 2,362, which is 8.9 percent of the overall enrollment.
  • The number of Oregon resident students increased from 17,360 to 17,487.
  • OSU continues to attract high-achieving students, and the mean grade point average of entering freshmen this fall was 3.56. More than 40 percent of incoming freshmen from Oregon high schools had a GPA of 3.75 or higher.

?We also continue to attract more high school valedictorians and salutatorians than any other institution in the state,? pointed out Kate Peterson, OSU?s associate provost for enrollment management. ?The university also has made major efforts to retain students and we?re beginning to see some of the results.?

Peterson said the number of new students on campus grew by 241 students over 2011 while the number of continuing students jumped by 1,191 over last year.

University officials note that OSU has hired more than 100 new faculty members over the past two years ? from throughout the United States and beyond ? to help accommodate the enrollment growth.

Students enrolled this fall at OSU come from every county in Oregon, from every state in the United States, and from 98 other countries. The university saw enrollment growth that was roughly the same among undergraduate and graduate students, totaling 5.7 percent.

The largest student enrollment by discipline belongs to the College of Engineering, which has 5,907 students this fall. Next in order were the College of Liberal Arts, 3,680 students; College of Science, 3,406; College of Business, 3,302; College of Public Health and Human Sciences, 3,267; and College of Agricultural Sciences, 2,284.

OSU?s minority enrollment has more than doubled in the last decade, from 2,591 students in 2003 to 5,224 this fall. Likewise, Oregon State?s international student enrollment has increased from 1,061 students in 2003 to 2,362 students this fall.

(AP) ? Four female service members filed a lawsuit Tuesday challenging the Pentagon's ban on women serving in combat, hoping the move will add pressure to drop the policy just as officials are gauging the effect that lifting the prohibition will have on morale.

The lawsuit, filed in federal court in San Francisco, is the second one this year over the 1994 rule that bars women from being assigned to ground combat units, which are smaller and considered more dangerous since they are often in battle for longer periods.

The legal effort comes less than a year after the ban on gays serving openly was lifted and as officials are surveying Marines about whether women would be a distraction in ground combat units.

"I'm trying to get rid of the ban with a sharp poke," said U.S. Army Staff Sgt. Jennifer Hunt, who was among the plaintiffs in the latest lawsuit and was injured in 2007 when her Humvee ran over an improvised explosive device in Iraq.

Hunt and the other three women said the policy unfairly blocks them from promotions and other advancements open to men in combat. Three of the women are in the reserves. A fourth, Marine Corp Lt. Colleen Farrell, leaves active duty this week.

Women comprise 14 percent of the 1.4 million active military personnel. The lawsuit alleges that women are barred from 238,000 positions across the Armed Forces.

At a Washington, D.C., news conference, Pentagon press secretary George Little said the Defense Department was making strides in allowing more women into combat. He said Defense Secretary Leon Panetta has opened about 14,500 combat positions to women.

"And he has directed the services to explore the possibility of opening additional roles for women in the military," Little said. "His record is very strong on this issue."

American Civil Liberties Union Ariela Migdal, who represents the four women, said Panetta's actions weren't enough. She called for an end to the combat ban. "These tweaks and minor changes on the margins do a disservice to all the women who serve," she said.

"It falls short," she said. "It is not enough."

Marine Corps Capt. Zoe Bedell said she left active duty, in large part, because of the combat exclusion policy. Bedell said she was frustrated that her advancement in the Marines was blocked by her inability to serve directly in combat units.

"The military is the last place where you are allowed to be discriminated against because of you gender," she said.

Bedell said the blurred front lines of modern warfare, with suicide bombs and sniper attacks, have put more and more women in combat situations.

More than 144 female troops have been killed and more than 860 have been wounded in Iraq and Afghanistan since the wars began, according to Pentagon statistics.

Military leaders say they want to make sure lifting gender-based barriers would not disrupt the cohesion of the smaller combat ground units and military operations.

The Marine Corps' top leader, Gen. James Amos, ordered a survey of 53,000 troops to get their views, including whether they believe women in those units would distract male Marines from doing their jobs. The results have not been released yet.

The lawsuit alleges the ban violates constitutional female service members' equal rights. "As a direct result of this policy," the lawsuit states, "women ? as a class and solely because of their gender ? are barred from entire career fields.

The lawsuit also alleges that women are already serving unofficially in combat units.

Air National Guard Major Mary Jennings Hegar sustained shrapnel wounds in 2009 when she exchanged fire on the ground in Afghanistan after her Medevac helicopter was shot down. Both she and Hunt received Purple Heart medals for their injuries.

The lawsuit was assigned to U.S. District Judge Edward Chen, an appointee of President Barack Obama.

(AP) ? Israel and Palestinian militants from the Gaza Strip began indirect talks Monday in Egypt aimed at forging a new era of relations between the bitter enemies following a cease-fire that ended the heaviest fighting in nearly four years.

The talks, being mediated by Egypt, were the first negotiations since the cease-fire took effect last Wednesday, halting eight days of airstrikes targeting militant groups in the Palestinian territory and rocket attacks that reached deep into Israel.

Israel launched some 1,500 airstrikes in a bid to end rocket attacks out of Gaza, while the Hamas and the Islamic Jihad militant groups fired a similar number of rockets at Israeli cities. More than 160 Palestinians, including dozens of civilians were killed. Palestinian attacks killed Six Israelis, including four civilians and two soldiers.

Now that fighting has subsided, Egypt is working with the sides on carrying out the second phase of the agreement: negotiating new border arrangements for the impoverished coastal strip.

The negotiations will not be simple. The militants want Israel to lift what remains of its blockade of Gaza, imposed five years ago after Hamas seized control of the territory from its Western-backed rival Palestinian President Mahmoud Abbas. While Israel has eased the blockade in recent years, key restrictions remain in place on exports out of Gaza and the entry of badly needed building materials into the territory.

The Palestinians are hopeful that Egypt's new Islamist government will ease its own restrictions on movement in and out of the territory. Egypt still limits foot traffic through the Rafah border crossing. The militants also hope to turn the Rafah terminal into a major cargo crossing.

In return, Israel wants an end to arms smuggling into Gaza. Iranian-made weapons have made their way into Gaza through a circuitous route that ends with underground tunnels along the Egyptian border.

An Israeli official, speaking on condition of anonymity because he was not authorized to discuss the negotiations with the media, said Israel is prepared to take steps to help Gaza's civilians but would be wary of doing anything that could strengthen Hamas. In particular, he said the issue of arms smuggling would be high on the agenda.

"Our assessment is that successfully preventing the rearmament of Hamas and other groups is an integral element of maintaining long-term peace and quiet," the official said.

Yasser Othman, Egypt's top diplomat in the West Bank, confirmed the talks had begun.

Ghazi Hamad, a Hamas official in Gaza, said the group's economics minister, Ziad al-Zaza, was leading the Palestinian delegation. He gave no further details, and it was unclear whether any timeline was imposed for implementing the deal.

But militant leaders already have said they will not give up the vast arsenals they have accumulated. In the recent fighting, Hamas and Islamic Jihad unveiled new rockets capable of striking deep into the Israeli heartland, in addition to anti-tank and anti-aircraft weapons.

In an interview Monday, Islamic Jihad leader Ramadan Shallah said Iranian President Mahmoud Ahmadinejad called him and Hamas' prime minister, Ismail Haniyeh, to offer congratulations after their battle with Israel.

"Iran has been providing us with the support we needed to defend ourselves in the face of the Zionist occupation. Iran supported us militarily and financially and with everything we need to stand steadfast on our land," Shallah said. "We appreciate that and hope that all the Arab countries do the same."

He also said he hoped the latest fighting would inspire Palestinians in the West Bank to rise up against Israel as well.

Abbas, an outspoken critic of violence, has governed in the West Bank since Hamas overthrew his forces in Gaza in 2007. The rival governments repeatedly have failed to reconcile.

After four years of deadlock in peace efforts with Israel, Abbas this week is asking the United Nations to grant the Palestinians upgraded observer status and recognize a Palestinian state in the West Bank, Gaza Strip and east Jerusalem, territories captured by Israel in the 1967 Mideast war. The motion, largely symbolic, is expected to pass easily in the U.N. General Assembly.

In a statement, Hamas announced that its supreme leader, Khaled Mashaal, called Abbas to welcome the decision to go to the U.N.

Israeli officials ? backed by the Obama administration ? strongly oppose the move in the belief it is an attempt to bypass negotiations, but they have not said how they will respond.

(AP) ? A Little Falls man faces arraignment Monday in the shooting deaths of a pair of teenage cousins who went missing Thanksgiving Day and whose bodies were found by police the next day in the basement of the man's central Minnesota home.

Little Falls school officials identified the victims as cousins Haile Kifer, 18, and Nicholas Brady, 17.

Police on Sunday were holding Byron David Smith, 64, of Little Falls, who they expected will be charged Monday with second-degree murder.

Smith told police he shot the two during a break-in, but authorities have said his actions exceeded a reasonable self-defense.

The Minneapolis Star-Tribune reported that about 200 people gathered Sunday night for a vigil at Little Falls High School for Kifer and Brady. Mourners remembered both as athletic and friendly.

The newspaper also interviewed Bruce Smith, the suspect's brother, who said several break-ins had left his brother feeling vulnerable and afraid.

Family members of Kifer and Brady could not immediately be reached for comment.

Details about the shooting remained murky Sunday. Morrison County deputies visited Byron David Smith's home just north of Little Falls on Friday afternoon on a suspicious activity call, at which point, they say, he immediately confessed to shooting two people the previous day around noon. Deputies found the bodies in the basement.

Smith's brother told the Star-Tribune on Sunday that his brother was upset after the shootings and unsure how to react.

"Put yourself in his shoes after you shoot two people in your basement," Bruce Smith said. "How are you going to react?"

Morrison County Sheriff Michel Wetzel said Sunday that Byron David Smith claimed the teenagers broke into his home. But Wetzel said circumstances at the scene led investigators, including some from the state Bureau of Criminal Apprehension, to believe that his actions were in excess of simple self-defense.

Wetzel refused to release further details, including whether investigators believe that Smith shot the teenagers immediately upon finding them. Wetzel planned to hold a news conference Monday in Little Falls, where he said he would release a fuller picture of what happened.

"We do want to give the public a clear picture of what happened," Wetzel said. He said investigators were still actively working the case.

Kifer was a senior at Little Falls High School. Superintendent Stephen Jones said she competed in gymnastics and swimming and helped manage the boys wrestling team. Brady had attended the same school up through the previous school year, at which point he transferred to nearby Pillager High School.

Jones said the Morrison County Sheriff's Department notified him of the identity of the victims. Little Falls students have a scheduled day off Monday, but Jones said grief counselors will be on hand anyway, and students and their parents will be invited to come to school and talk about what happened. He said more counselors will be in place on Tuesday when all students return; Pillager High School also planned to have counselors available.

Jones said Brady had wrestled for Little Falls before transferring schools. "These were both friends to a lot of folks, involved in lots of activities and working their way towards graduation like so many other kids, trying to put their focus on the future," Jones said.

Few details were immediately available about Smith, whose home is in a secluded area north of Little Falls and near the Mississippi River. Wetzel said he was not previously known to the sheriff's department as a troublemaker, and his name doesn't turn up any previous convictions in a state criminal history database. The Star Tribune quoted a neighbor, John Lange, who said Smith was a retired security worker and volunteer Scout leader who cared for his elderly mother until her recent death.

"He's a really decent guy. I think he just snapped," Lange told the newspaper.

A Facebook page set up to mourn Kifer and Brady was getting heavy traffic on Sunday afternoon. Fellow students and alumni from Little Falls High School were planning a Sunday night candlelight vigil at the high school football field.

What Your Emergency Survival Kits Should Contain

Emergency survival kits are just that they are kits that will help you get through a real emergency. A survival situation is the balance between life and death. There are so many situations where you would need a survival kit.

You can put together or purchase a kit for the home,the car and outdoors. Every home in America should have at least one survival kit for every member of the house. The last decade has seen some of the worst violence in American history.

The last decade has also seen some of the worst storms in all of history. Having a survival kit is not a luxury it is without a doubt a necessity. The Federal government even recommends that every home should have an emergency kit for every member of the household.

For the Home Family of Four

Each emergency kit should contain at least:

Three days of water Three days of food Medical supplies Important documents (at least copies) Can opener portable radio flashlight candle lighter city map portable car charger for cell phones

To effectively survive any disaster natural or man made the above items need to be present and ready for use. You can either put together this kit yourself or you can buy one. You want to be sure to have enough food and water to last at least three days.

Medical supplies should be a freshly stocked first aid kit and if any family member is diabetic or needs other life saving treatment/medication than that should also be present (rotate frequently to insure freshness).

Keep copies of all your important documents in the kit. Things like birth certificates, insurance policies for the home and the car and any other documents that may be hard to replace in a time of crisis.

A can opener ( you would be surprised how many people forget this) so you can open canned goods. A portable battery operated radio so that you can get news from the outside world is also important. Flashlights so that you can see should the power go out, candles for the same reason.

Make sure you have a lighter they are more reliable than matches. A map of your neighborhood or city so you know exit routes. Portable car charger for cell phones.

A good investment is a solar hank cranked lantern and radio just in case the emergency lasts longer and you run out of batteries.

Keep some cash and some change stashed in your kit. If the power goes down so does the ATM's bank's and other places that you can get money. Remember when the power goes down there is no place to ge gasoline either.

Any good survival kit will be compact enough to move around yet stacked enough with the gear that you and your family will need to make it through the crisis. A lot of families by one kit for each member although it is not necessary.

Hope for the Best Plan for the Worst

It is always best to plan ahead just in case. There were so many families that lost their basic ability to feed their families during some of the awful storms mother nature threw at them. Many times these storms struck in the dead of the night without warning.

Hundreds and in some cases thousands of people were killed or died after the fact. A little planning can go a really long way in surviving it does not take long to put a kit together and to purchase one is relatively inexpensive.

It is worth the peace of mind to be prepared.

For the Individual

If you are an outdoors person and journey into the woods, out on the ocean or anywhere that takes you away from the population and emergency kit should be a part of your planning as well. In the event you never use the items in your emergency kit that is perfect but if you need the items it is nice to know that they are there!

The same items for the home can be used in your outdoor survival kit just scale it down to make it easy to carry!
